 7 steps to safeguarding your rights

 

1. DO NOT waive your Marinda rights. (your right to have an attorney present during  questioning)  Immediately, and politely, request to speak to an attorney.

2. DO NOT sign any documents while in police custody or in presence of law enforcement without first having an experienced attorney review them.

3. Inform the police that you will only speak to them with your attorney present.

4. Be respectful to law enforcement agents and allow them to process your paperwork, by offering them your name, address, social security number and your phone number and the phone numbers of family members and individuals who can assist you with bail, locating a criminal defense attorney, and communication with other friends and family members that you need assistance.

5. DO NOT agree to any of the following without first speaking to your attorney:

a. a polygraph test (lie detector)

b. a breathalyzer

c. a blood test

d. a drug test

e. a hair follicle test

f.  a DNA test or sample

e. a physical exam or any other type of test.

f. physical searches of your property

g. physical searches of your body and person (except upon arrest and upon incarceration- law enforcement has a duty to maintain their and your safety)

6. If you are to appear in court, be respectful and tell the judge that you would like the assistance of an attorney before making any statements in court.
