Chambers & Booth
Your Rights 101
When a person becomes involved with law enforcement through a simple traffic stop or a full arrest and then arraignment, they have questions about what their rights are and who can best protect them. At Chambers and Booth we understand the fear an anxiety that comes with any involvement in the criminal law system.
REMEMBER, you have a number of very important rights that were created to protect you.
The simplest but must important right you have is ...
To refuse to give law enforcement any information which can be used against you. You have the right to remain silent- especially silent as to the events that law enforcement is questioning you about.
Good decent people who have lived their entire lives obeying the law will naturally feel obligated to account for their actions when law enforcement6 questions them...... Law enforcement agents use this basic fact about human nature to obtain evidence against you. You have the right to remain silent - USE IT.
You have the right to have an attorney (who represents
your best interest) present during police questioning.
Over the years, our office has seen countless cases where law enforcement did not initially have sufficient probable cause to stop or arrest a person but then obtained enough probable cause or evidence to charge our client with a crime. How did the police obtain enough probable cause or sufficient evidence? OUR CLIENT'S OFFERED IT by voluntarily making statements and agreeing to take a field sobriety or breathalyzer tests, to have their home, automobile and bags searched.
REMEMBER You have some rights to be free from an unlawful search:
1. Do not offer to take the field sobriety test or breathalizer if you are intoxicated.
2. Do not give evidence against your self by admitting to anything until you speak to your attorney.
3. Do not give your permission for law enforcement to search your person, your bags, your automobile or your home.
4. Do contact a qualified and experienced criminal defense attorney to obtain legal advice about your specific circumstances.
Avoid jeopardizing your future
